My goal was to create a small book to be for all who practice law what Strunk and White's The Elements of Style is for all who write. I hope it also will be used in law schools to give law students some guideposts for practicing law honorably and some compass points for ethics. There are more than one million practicing l Read More

Professional Responsibility State Rules and Ethics Opinions Professor Barbara Glesner Fines University of Missouri - Kansas City School of Law 1996 For educational purposes only; not to be used as a source of authority. STATE RULES AND ETHICS OPINIONS An attorney wishing to obtain an advisory ethics opinion may have a number of sources to which he can direct his inquiry. In some states, the Supreme Court or the state disciplinary authority provides binding ethics opinions (similar to revenue rulings issued by the Internal Revenue Service). In most states, one can obtain a purely advisory opinion from the state bar association, a local bar association, or from a private attorney or law professor. The following outline describes the process by which advisory opinions are issued by the state Read More

Charles F. Luce, Jr. On Legal Ethics and the Practice of Law

The author, who practices law to support his 100LL habit, and his father prepare to embark on a cross-country barnstorming trip in a 1965 Twin Comanche. Welcome. I first became interested in the practical application of legal ethics in law school. As an alternative to a written final exam, my buddy, John Gray, and I collaborated on a project to demonstrate our comprehension of the then-intricate rules of attorney advertising by writing and producing un ethical legal radio advertisements which systematically violated each and every rule. Later, John Carver and the University of Denver College of Law gave me the opportunity to teach Legal Professional as a Lecturer in Law at DU. About the same time, I joined the Colorado Bar Association's Legal Ethics Committee, one of the finest groups of p Read More

We present here an hyper-text made up out of portions of Bentham's work, together with lectures, commentary, notes, essays, on Bentham. At present, what is here is the Introduction to the Principles of Morals and Legislation , The Rationale of Reward , The Rationale of Punishment , and other texts, and some lectures about Bentham---that are linked into the IPML---by Stephen Darwall. Lawyers Have a Variety of Options for Online MCLE Courses Even participatory credit is available for those who would rather study entirely online By Carole Levitt Carole Levitt is president of Internet For Lawyers, a legal, business, and investigative training company. She can be reached at clevitt@netforlawyers.com . Lawyers in California know that SB 144 reduced the number of required MCLE hours from 36 to 25 and ended the law practice management requirement. It is not as widely known that, in recognition of the accessibility of the Internet, the legislature made it clear that attorneys can satisfy the full self-study portion (12.5 hours) of their MCLE requirement by taking courses online. Furthermore, to ease the financial burden of MCLE, the legislature has mandated that the State Bar Read More

Legal Ethics in Cyberspace

Legal Ethics in Cyberspace by Stephen T. Maher [1] Legal Ethics in Cyberspace By Stephen T. Maher The development of a virtual online space where lawyers can advertise, chat, make and answer posts, send and receive e-mail, find clients and communicate with them, has happened so fast that most codes governing lawyer conduct have not had a chance to catch up. That does not mean that there are no rules governing online conduct. It means that you may have to look farther than the published Canons or Rules of Professional Conduct in a jurisdiction to find the policies that exist or are being developed to govern lawyer conduct in Cyberspace. Since legal ethics rules vary by jurisdiction, it is not possible to generalize with complete confidence about what requirements now exist. But it is possib Read More

THINKING ABOUT ETHICS-LAW VS ETHICS

Votes:0
Ethics and the Law Dr. Erich H. Loewy Professor and Endowed Alumni Association Chair of Bioethics Associate, Department of Philosophy University of California, Davis In my view (and that is my view and, therefore, may well be wrong) one of the measures of civilization in a society is to see if its laws derive from ethics or if its ethics (or at least its ethos) derive from laws. In my view, the more civilized a society the more is the former the case. Another measure is the protection of the vulnerable within such a society, something which is closely related. The Nazi example fits -- mark you, I am not saying the holocaust, I am saying the Nazi state. The ethos shifted with the NÜrnberg laws so that what was formerly simply not done became doable. The reciprocal influence of law on ethos Read More

WhatEvery Client Should Know About Legal Ethics

What Every Client Should Know About Legal Ethics Have you ever wondered what ethical obligations lawyers owe their clients? Ethical issues came to the forefront for Colorado lawyers when the Colorado Supreme Court adopted the Colorado Rules of Professional Conduct, (effective in 1993), and Colorado lawyers had to learn a whole new set of ethical rules. Colorado's rules of legal ethics are more protective of clients than almost any other state's. The Rules are both written and enforced (in lawyer disciplinary or "grievance" proceedings) by the Colorado Supreme Court. This article introduces clients to some of the more important issues. The Client-Lawyer Relationship: The Rules recognize that the client establishes the objectives for the lawyer's representation. After consulting with the cli Read More
